Terms of Service

By accessing or using my website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the website or services.

These Terms constitute a legally binding agreement between you and Tim Green Develops trading as TIMOTHY JAMES GREEN, a sole trader operating in Australia.

I provide software development services including but not limited to:

• Web application development
• Website design and development
• API development and integration
• Technical consulting
• Code review and optimisation

Specific terms for each project will be outlined in a separate Statement of Work or contract agreed upon before commencement.

My Website: All content, design, code, and materials on this website are my intellectual property or that of my licensors. You may not reproduce, distribute, or create derivative works without my express permission.

Client Work: Upon full payment, intellectual property rights for custom work will transfer to you as specified in our project contract. Third-party components (open-source libraries, APIs) remain subject to their respective licenses.

• Payment terms will be specified in your project proposal or contract
• A deposit may be required before work begins
• Payment is due within 14 days of invoice date unless otherwise agreed
• Late payments may incur interest charges at the rate of 8% per annum
• All prices are in Australian Dollars (AUD) unless otherwise specified

To the maximum extent permitted by Australian law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the services
• Any conduct or content of any third party on the services
• Any content obtained from the services
• Unauthorized access, use, or alteration of your transmissions or content

I warrant that services will be performed with reasonable care and skill. However, I do not warrant that:

• The services will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of the services will be accurate or reliable
• Any errors in the service will be corrected

Services are provided "as is" without any warranty of any kind, either express or implied.

Either party may terminate a project with written notice. Upon termination, you will pay for all work completed up to the termination date. Any deposits paid are non-refundable unless otherwise specified in writing.

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.

I reserve the right to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically. Continued use of the website following any changes constitutes acceptance of those changes.
